Garfield B. Simms, a Registered Patent Attorney, is a Partner in Tully Rinckey PLLC's Intellectual Property (IP) Law Practice in Washington, D.C., where he litigates a range of matters related to IP, including patent, trademark and trade secret infringement.
Garfield brings more than 20 years of IP litigation experience to Tully Rinckey PLLC and has successfully litigated numerous matters involving complex technologies, including light-emitting diodes, digital imaging, digital televisions, digital cameras, wireless technologies, electronic sensors, electronic commerce, data caching, bar code readers and power management systems in electronic devices.
His IP experience involves both offensive and defensive matters. He has appeared in district courts and before the International Trade Commission (ITC). His experience includes providing strategy, performing extensive case research, drafting legal memoranda, preparing letter motions, briefs, claim contentions, as well as conducting all aspects of discovery, interfacing with various testifying and consulting experts, and conducting depositions. His experience spans initial investigations determining infringement, through motions practice, Markman hearings and trial. He also has first chair trial experience before the ITC.
Additionally, Garfield has prosecuted trademark applications and drafted electrical and mechanical patent applications. In particular, he has drafted patent applications for various technologies including electronic circuits, internet security systems, semiconductor devices and processes, medical diagnostic systems, optical instruments, biometric identification systems and imaging systems. He also has prepared foreign and U.S. office responses, performed miscellaneous patent prosecution duties and counseled clients.
Garfield has consistently provided pro bono services for many years and received special recognition for his work. He also has been a member of the board of directors of the Lawyers Committee for Civil Rights Under Law since 2009. He has also been recognized as one of the National Black Lawyers Top 100.
In addition to his legal background, Garfield has extensive teaching experience, serving as Assistant Professor teaching calculus and pre-calculus to business and pure science majors and conducting research on novel semiconductor devices at Hampton University in Hampton, VA; teaching PASCAL to high school students in a NSF-funded summer program at the University of Massachusetts, in Amherst, MA; and as a teaching assistant at the University of Delaware, in Newark, DE, where he monitored student progress in basic semiconductor physics and electricity and magnetism.
Garfield obtained his law degree from Northeastern University School of Law; his PhD and master's degree from the University of Delaware (Electrical Engineering); and his bachelor of science degree from Delaware State College in Physics/Mathematics (cum laude).
He is admitted to practice before the U.S. Patent and Trademark Office and the District Court of Massachusetts. He is a member of the District of Columbia, Massachusetts, American and National bar associations, the International Trade Commission Trial Lawyers Association (ITCTLA) and the American Intellectual Property Law Association.
