Victoria Kennedy joined Russo & Toner in 2018 as Senior Counsel. Her practice focuses on insurance defense including coverage analysis and premises liability, contract negotiation and disputes, labor and employment matters, and complex commercial litigation including IP. Prior to joining Russo & Toner, she held the position of Counsel with French & Casey, LLP as an insurance defense and commercial litigator. She was also Senior Trial Counsel for Fidelity National Title Insurance, and a Senior Associate in litigation and government compliance attorney with global law firm White & Case LLP. Victoria is included among the prestigious National Black Lawyers: Top 100.

Victoria also provides outside general counsel services to companies that either lack in-house legal departments or require additional legal support, advising on contracts, construction/real estate, and employment/HR matters.


In re N.J.H., (NYS Div. Human Rights) Mar. 13, 2017, obtained dismissal of all employment discrimination claims brought against client

Bell v. Stan Deutsche (Queens Sup. Ct.) Dec. 10, 2016, prevailed on motion to quash subpoena seeking financial disclosures and testimony from non-party client in shareholder/unfair competition dispute

J. Petrocelli v. The Morganti Group Inc. (Suffolk County) - April 4, 2014 Decision granting motion to dismiss plaintiff's breach of contract claims for $4.25 Million in construction delay damages, affirmed by Second Department on Mar. 23, 2016, 137 A.D.3d 1082 (2d Dep't 2016)

Coleman-Yarborough v. Betances Community Center, Inc. (Bronx County) - February 24, 2014 Motion for summary judgement granted dismissing complaint for fractured ankle arising out of ice-skating collision.

Rembert v. Navillus Tile Inc. (Kings County) - November 25, 2013 Order granting motion for summary judgment dismissing claims and cross-claims related to head injury/fall from sidewalk shed.
