This position does not require membership in the Utah State Bar for the first year and may be filled by a non-Utah resident who works remotely for the first year of employment.

The Utah Attorney General’s Office seeks to hire an Assistant Attorney General to specialize in Title IX, Title VI, ADA, and other civil rights litigation as it relates to educational institutions. The ideal candidate would have 5 years’ experience or more litigating civil rights and Title IX cases in federal court. The position may also be filled with a first-year lawyer who has prior experience in or a demonstrated interest in Title IX compliance and related legal issues. Excellent writing and oral advocacy skills are required.

In addition to handling Title IX and related civil rights litigation, the position would involve creating and conducting trainings for educational institutions, including colleges, universities, charter schools, and local school districts.

This position is in the Litigation Division of the Utah Attorney General’s Office which primarily handles cases covered by the Utah Division of Risk Management’s insurance fund. The position involves collaboration with Risk Management in assisting covered educational institutions in complying with Title IX and other civil rights statutes, including: screening pre-litigation issues with state agencies and educational institutions; working with the AG’s Office and Risk Management on legislative matters, conducting trainings for administrators, and assisting with policy development for primary, secondary and high education institutions. The successful candidate will work on high-profile Title IX and civil rights litigation presenting novel legal issues. In recent years the Litigation Division has handled highly-publicized matters including Title IX sexual harassment cases and a two-week class action bench trial on whether Title IX or the Equal Protection Clause require school districts to offer girls’only tackle football, Gordon v. Jordon School District, 522 F.Supp.3d 1060 (March 1, 2021). This position offers the successful candidate the unique opportunity to work on the cutting edge in a rapidly developing area of the law.
